What are the eligibility criteria for an immigration bond?

There is a set criterion for the detainee to qualify for the immigration bond. The held individual will go through a hearing process where a judge will look at their particular case and decide based on that specific situation. Moreover, some reasons related to the background history may not make them eligible for the bond.

  • If the individual’s crime is on the list, it is a detention crime, and the judge holds no power to decide on the bail.

  • However, if the crime is none amongst the ones mentioned in the list, the immigration judge will need to look at the consequences to know what would happen after the person has been released on bail.

What is the amount of money paid for the immigration bail?

The cost of an immigration bail bond is set either by an immigration judge or the I.C.E. Besides, it depends upon factors like the immigration status of the detainee, their criminal history, employment status, U.S. family ties, etc., whether the bond amount needs to be raised or lowered.

The minimum bond amount is as low as $500 and can go as high as $50,000 or more in some cases.

What happens after the bond is approved and paid?

Once the person has paid the bonds, the case is moved to another immigration court, where the undocumented immigrant used to live before he was arrested.
