It is the most petrifying moment when you find out that one of your loved ones has been held and getting detained. The situation is indeed a desperate one, but panicking and losing hope is not a solution. Thanks to the immigration bonds that can now help you release your loved ones from detention.
So, what is an immigration bond?
Mostly, the non-citizens suspected of not holding a legal residence in the United States are likely to become subject to arrest and detainment. As a result, an immigration bail bond is required when a person gets arrested by the U.S. Immigration and Customs Enforcement (I.C.E.), a government organization, for immigration reasons.
If the detainee is found eligible for release, an amount will be set for a bond, called the immigration bond.
In case a person does not have sufficient identification to prove they have a legal right to stay in the U.S.A. and is discovered by law enforcement or detained by Immigration and Customs Enforcement (I.C.E.), the person is arrested.
There are three types of immigration bonds:
Delivery Bond: If a person wants to be released on a Delivery bond, the arrested foreigner or the illegal immigrant is required to obtain an arrest warrant and a notice of custody conditions from I.E.C. Moreover, it is issued on the condition that the defendant will appear at all immigration hearings.
Voluntary Departure Bond: This bond is issued by the judge to let the detainee leave the country in a specific period at their own expense. Moreover, it is granted prior to any court hearings. If the defendant leaves the U.S. during the specified time, the departure bond paid to the I.E.C. is refunded. However, if the detainee fails to leave the country, the bond is forfeited.
Order of Supervision Bond: This bond is for immigrants who have a deportation order and want to receive documentation (like passports) for family members. Also, it is used to warrant that all terms & conditions of supervision are met and the individual surrenders for removal.
There is a set criterion for the detainee to qualify for the immigration bond. The held individual will go through a hearing process where a judge will look at their particular case and decide based on that specific situation. Moreover, some reasons related to the background history may not make them eligible for the bond.
People who might be a risk of danger to the community are likely to be denied a release with the help of bonds after arrest.
Moreover, people who currently have a deportation order may need to hire and seek the help of an experienced immigration lawyer to confirm whether they are eligible for an immigration bond.
It may be difficult for people with past criminal charges to get an immigration bond without an attorney.
Here are some reasons that convince the deportation officers to approve the immigration bond.
If the arrested immigrant doesn’t have a serious criminal record.
If there is no immigration arrest warrant or criminal arrest warrant against the undocumented immigrant
If the undocumented immigrant did not reenter the U.S. illegally after deportation
If the undocumented immigrant is going through a severe health issue.
The judge goes through the arrested immigrant’s criminal record. There is a list of crimes of violence, moral turpitude, and other serious criminal offences.
If the individual’s crime is on the list, it is a detention crime, and the judge holds no power to decide on the bail.
However, if the crime is none amongst the ones mentioned in the list, the immigration judge will need to look at the consequences to know what would happen after the person has been released on bail.
Moreover, the person has to agree to go to all the immigration court hearings and reassure that he is not a threat to the community.
The cost of an immigration bail bond is set either by an immigration judge or the I.C.E. Besides, it depends upon factors like the immigration status of the detainee, their criminal history, employment status, U.S. family ties, etc., whether the bond amount needs to be raised or lowered.
The minimum bond amount is as low as $500 and can go as high as $50,000 or more in some cases.
Note: Posting immigration bail bonds do not guarantee that an individual won’t be deported from the country. It just ensures that the arrested people can unreservedly meet and discuss with their attorneys, who can further guide them to take other steps to resolve their situation with the U.S. Citizenship and Immigration Service.
Once the person has paid the bonds, the case is moved to another immigration court, where the undocumented immigrant used to live before he was arrested.
Now. the arrested immigrant will be scheduled for an immigration court deportation hearing in the area where he resides in the U.S.
